Labour Court awards €7,500 to Branislav Gajdos on victimisation appeal

The Labour Court upheld two victimisation complaints brought by Branislav Gajdos against Securikey Limited and ordered the company to pay him €7,500 compensation. The determination was signed on 4 December 2013.

Gajdos appealed after the Equality Officer found his complaints not well founded. He alleged that his work assignments changed after his solicitor raised concerns about his treatment, and that he was later dismissed. Securikey said its staff could be assigned across its service areas and cited roster requirements and absences in explaining the dismissal.

The Court found that all his shifts after the solicitor's complaint were in Clonmel and that Securikey's explanation for the change was not persuasive. It also found the absences the company cited came after the dismissal decision. His separate complaint of race discrimination in conditions of employment was not well founded because the evidence did not show he was treated less favourably than other workers.
