The Workplace Relations Commission awarded Gavin O'Toole €2,106 for each of two failures to provide written employment terms and found he was entitled to a statutory redundancy lump sum. Its decision was dated 16 March 2023. Mr O’Toole said he worked for G & G Ross Stonecrushers from January 2015 until his dismissal in April 2022, without receiving written terms or a redundancy payment. The employer did not attend the hearing. The WRC found the job became redundant after the company ceased operating in the Republic of Ireland. It also found that the employer had failed to provide written core terms and other employment terms. The redundancy lump sum is to be calculated by the relevant Department, subject to the requirement that Mr O’Toole was in insurable employment.
