The Workplace Relations Commission has ordered M.H Gill & Co. Unlimited Company to pay former education sales representative James Higgins €60,000 after finding his dismissal was unfair. In a decision dated 14 September 2026, the WRC accepted that a genuine redundancy existed but found the selection process unfair.
The adjudication officer found that Higgins was not told his role was at risk, given the selection criteria or offered a meaningful chance to discuss alternatives or appeal. The company had argued the redundancy was genuine and fairly carried out, citing financial losses and changes in schoolbook purchasing.
The WRC also found that his separate redundancy-payment and Payment of Wages complaints were not well founded. The latter included claims about unpaid annual leave and expenses.
