The Workplace Relations Commission ordered Agus Victuals Limited to pay executive chef Brian McCafferty €9,890 for 43 days of wages and other pay it had unlawfully deducted. The WRC also upheld his complaints over a guaranteed tipping bonus and missing written employment terms.
Adjudication officer Penelope McGrath’s decision was dated 8 July 2024. McCafferty said the restaurant’s unexpected closure left him without wages due to him. The company said it had to close because of problems with its landlord and accepted the claims in principle.
The WRC ordered payment of €4,745 under the guaranteed tipping scheme and €100 because McCafferty had not received a statement of employment terms within two months of starting work. The company witness accepted that the bonus was owed. The decision records the awards separately; it did not make a combined award.
