Labour Court upholds decision in Derrycourt transfer appeal

The Labour Court affirmed a decision against Jelena Jevsejeva in her appeal over a transfer of undertakings involving Derrycourt Cleaning Specialists. Jevsejeva, the worker who brought the appeal, argued her employment should have transferred and sought wages for the intervening period. The Court found that she had declined to accept the transfer, so the appeal failed. The transfer took place on 14 November 2022, when the client site where Jevsejeva worked moved from Dundrum to Portrane. Derrycourt said it had told her to report to the site, but she had made clear that she did not want her employment to transfer. The Labour Court heard the appeal on 15 January 2025 and signed its decision on 27 January 2025.
