Ann Walsh awarded €1,990 over missing written employment terms

Ann Walsh was awarded €1,990 after the Workplace Relations Commission found Donegal Education & Training Board had breached employment information rules by failing to give her written terms when her role changed in 2015. The decision was dated 6 October 2023. The WRC found the breach continued until Walsh’s employment ended, so her complaint was in time. Three other complaints were not well founded: that her contract did not reflect the work offered, unfair dismissal and failure to make reasonable accommodation. Walsh argued that the school’s refusal to let her return on restricted duties, and its offer of unpaid sick leave or ill-health retirement, amounted to dismissal. The WRC found a September 2020 letter did not end her employment. It also found that reorganising cleaning duties around her restrictions would have placed too much burden on other staff and compromised safety.
