The Labour Court has affirmed a finding that Zhihua Yuan’s complaint against Gaffney Mechanical Limited was not well founded under the Terms of Employment (Information) Act 1994. No award was recorded. The Court’s decision is dated 30 September 2026. Yuan said he remained an employee of Gaffney Mechanical and relied on a signed statement of employment terms and an employment permit naming the company. Gaffney Mechanical said its staffing needs had changed before Yuan arrived in Ireland and that it never employed him. The Court found Yuan had not established that he worked for the company during the relevant period, or that it had a legal relationship with the other entity that employed him. It therefore found no basis for the complaint and affirmed the Adjudication Officer’s decision.
