The Labour Court overturned a Workplace Relations Commission decision and awarded chef David Hasala €3,002.84 after finding his employer had not provided a written statement of his employment terms. The Court’s decision was dated 13 May 2024.
Hasala appealed after his WRC complaint failed when neither party appeared at the hearing. He told the Labour Court he had never received written terms, including the basic information employers must provide about a worker’s job. The employer did not attend the appeal hearing or make a submission.
The Court accepted Hasala’s uncontested sworn evidence, found the breach at the upper end of the scale and awarded the maximum compensation allowed: four weeks’ pay. It set aside the adjudicator’s decision and found the claim well founded.
