The Labour Court found David Hasala entitled to statutory redundancy pay after his former employer’s restaurant closed, overturning the earlier dismissal of his complaint. The decision, dated 13 May 2024, says the payment should be calculated using weekly pay of €750.71.
Hasala worked as a chef and later head chef at Mounthawks Inns Limited O’Donnell’s Bar and Restaurant. The Court found he had the required service and that the business had ceased operating. It set aside the Adjudication Officer’s decision, which had dismissed the complaint after neither party attended the WRC hearing. The respondent also did not appear at the Labour Court hearing.
