The Workplace Relations Commission said it had no jurisdiction to investigate Roman Wielinski’s TUPE complaint against Emerald Contract Cleaners (Ireland) Limited, trading as Emerald Facility Services. Adjudication Officer Catherine Byrne’s decision was dated 9 April 2025. The complaint concerned whether his employment terms were observed after a transfer. The WRC found it was first received on 19 April 2024, more than a year after his employment transferred on 14 November 2022, and outside the statutory time limit. Wielinski’s solicitors had said they submitted it in May 2023; the WRC found no online submission was registered and no complaint reference was generated then. No award was recorded.
