WRC dismisses Kritschgau’s TUPE complaint over time limit

The Workplace Relations Commission ruled it had no jurisdiction to investigate Piotr Kritschgau’s TUPE complaint against Emerald Contract Cleaners (Ireland) Limited. Adjudication officer Catherine Byrne’s decision was dated 8 April 2025. Kritschgau complained about the transfer of his employment from the cleaning contractor to Derrycourt Cleaning Specialists Limited. The WRC found the complaint was first submitted on 19 April 2024, outside the TUPE time limit, and said any relevant breach must have occurred before the transfer. The company submitted that timely filing was the responsibility of his solicitors.
