The Workplace Relations Commission allowed David Byrne’s redundancy appeal against Jayden & Preston Ltd t/a Parcel King, awarding him a redundancy lump sum based on gross weekly pay of €700. The decision was dated 2 May 2024. Byrne said he had worked for the business since December 2012 through successive takeovers and had not received redundancy pay. The company said he started in April 2023, was not made redundant and lacked the required service. The adjudication officer found that the business transfer carried the employment obligations to the respondent, and that Byrne’s position became redundant when its Sligo operations ceased. The lump sum was based on employment from 20 December 2012 to 25 August 2023 and was subject to the employment being insurable under social welfare law.
