The Workplace Relations Commission found it had no jurisdiction to hear a worker's complaint under the Safety, Health and Welfare at Work Act, in a decision dated 2 May 2024. The complainant had first referred a trade dispute under the Industrial Relations Act. After the employer objected within the statutory three-week period, a section 28 safety complaint was substituted at the complainant's written request. The WRC found it had no jurisdiction over that later-added complaint; a separate industrial relations complaint remained open.
WRC lacks jurisdiction over later-added safety complaint
