The Workplace Relations Commission found Kunabo Mutuaya’s redundancy complaint against Gcb Security & Facilities Ltd. well founded and ruled he was entitled to a statutory redundancy lump sum. The decision was dated 30 January 2023. Mutuaya worked as a security officer at a Waterford site that closed in March 2020. He was laid off from July 2021 and sought redundancy, saying no reasonable alternative work had been provided. The company did not dispute entitlement if he qualified, but challenged his claimed hours, saying he usually worked 16 to 20 hours a week at €11.65 an hour. The adjudicator found an October 2021 offer of work did not materialise and there was no counteroffer of reasonable alternative work. The WRC accepted normal hours of 20 a week and set gross weekly pay at €233. The lump sum is based on employment from 25 November 2016 to 11 January 2022 and is subject to Mutuaya having been in insurable employment during the relevant period.
