The Labour Court upheld the Rights Commissioner’s decision rejecting James Reid’s claim over Cork City Council’s ending of a weekly early morning allowance. In a determination dated 18 July 2016, the Court found the allowance was not properly payable after 2 April 2002 and its discontinuation was not an unlawful deduction from wages.
Reid said the allowance had been agreed in 2002 instead of pursuing a claim for unpaid afternoon supervisory hours. The Council said a 2006 agreement set his roster and pay and did not provide for the extra hours. Payroll records showed he had been paid in full for the earlier afternoon hours. The Court found there was no basis for the additional payment, valued at €319.40 a week when the issue came to light, and dismissed the appeal.
