The Labour Court upheld the finding that Harry O’Donovan dismissed Dylan Brennan without notice, but varied the compensation to €910, equivalent to two weeks’ gross pay. The decision was dated 15 October 2024. Brennan, a preventative maintenance cleaner, told O’Donovan he intended to return to work after his medical certificate expired on 27 September 2022. His attempts to arrange his return went unanswered. O’Donovan denied ending his employment and said he remained on the books. The Court found that O’Donovan’s conduct repudiated the employment contract and that he did not pay Brennan during the statutory notice period or in lieu of notice. It varied the adjudication officer’s decision accordingly.
