The Labour Court dismissed Tomasz Warzycha’s appeal against the rejection of his claim for six weeks’ notice pay from Sprint Coatings Limited. The determination was dated 30 November 2018. Warzycha argued he was entitled to six weeks’ notice after his summary dismissal. Sprint Coatings relied on a contract clause allowing dismissal without notice for certain serious breaches and said he was dismissed after admitting a serious breach of health and safety procedures. The Court said Warzycha had not shown that the employer could not rely on the statutory exception for misconduct. It affirmed the Adjudication Officer’s decision that the complaint was not well founded.
