The Labour Court determined that Rorer Ireland Limited could take disciplinary action for serious misconduct before the union began the grievance procedure under the Plant Agreement. It was an interpretation dispute brought by the Services Industrial Professional Technical Union after the company suspended a worker for two days following an incident on 5 November 1990. The Court's decision was signed on 4 December 1990. The union argued its objection rights extended through the grievance procedure, while the company said it could act first and handle a grievance afterward. The Court found section 6 of the agreement was the dominant clause.
