The Labour Court removed a recommended one-day unpaid suspension for a telephonist at St Brendan’s Hospital, in a decision dated 4 December 1990. The worker said she had written to explain she would not be available for duty on 26 December 1988. The Eastern Health Board said it received the letter on 3 January 1989 and that she declined to attend meetings about the incident. A Rights Commissioner had recommended the suspension, with the record to become defunct from 31 December 1990. The Court said the worker’s interests would be best served by accepting the Board’s offer to resume work. If she chose not to return, the Court was prepared to arrange expert advice on her pension terms and recommended that she accept that advice.
