The Workplace Relations Commission rejected Desmond Muldoon’s disability discrimination and workplace safety penalisation complaints against Mark Monaghan sole trader. In a decision dated 14 July 2025, adjudication officer Penelope McGrath found Muldoon had not established discrimination and was not dismissed in retaliation for raising a concern about lifting heavy fabric rolls.
Muldoon worked as a courier driver and alleged he was dismissed because of his disability after raising safety concerns. Monaghan denied discrimination and penalisation, saying Muldoon’s employment ended because he had not produced the valid driving licence required for the role. The officer found the licence was fundamental to the job and no award was made.
