The Workplace Relations Commission found Tomasz Zelazowski’s constructive dismissal complaint against Kyte Powertech Limited not well founded in a decision dated 18 August 2023. The WRC said the alleged conduct was not serious enough to entitle him to end his employment contract and have his resignation treated as a dismissal. Zelazowski said he faced bullying and penalisation after a workplace accident and related claim, and was reprimanded over attendance. Kyte Powertech denied the allegations and said his resignation was unrelated to his grievances. The WRC also found his Payment of Wages complaint not well founded. He had sought pay for the week of 23 to 30 June 2021, but the complaint was outside the time limit and the WRC said it had no jurisdiction to consider it further; the merits were not decided.
