WRC rejects Ricardo Guerra’s race discrimination claims against Abtran

The Workplace Relations Commission found that Abtran Ltd. did not discriminate against employee Ricardo Guerra on grounds of race. In a decision dated 4 July 2024, adjudication officer Thomas O'Driscoll rejected claims concerning unsuccessful job applications, victimisation and harassment. Guerra withdrew an original indirect discrimination complaint during the hearings. The adjudicator found that the evidence did not support an inference of race discrimination; the application made on 6 May 2022 was outside the time limit and was not investigated as a specific application.
