The Workplace Relations Commission upheld five complaints by warehouse manager Marcelo Dacosta against Jayden & Preston Ltd. t/a Parcel King, including unfair dismissal. Its decision was dated 24 September 2024. The WRC found Dacosta and his witnesses credible, while finding inconsistencies in the respondent’s evidence.
Dacosta said he worked long days, six days a week, without set breaks. The respondent disputed his account, saying he resigned and had received his employment entitlements. The WRC ordered payment of wages for the week of 7–13 August 2023 and work up to 2 pm on 14 and 15 August, without specifying an amount. It also ordered 13 days’ holiday pay, with €2,000 compensation for that breach; €2,000 for working-time breaches; €2,000 for the failure to provide employment information; and €4,000, equal to four weeks’ pay, for unfair dismissal. Dacosta began a new warehouse manager job two days after his dismissal. The decision also recounts a Company A manager’s visit to the respondent’s Sligo warehouse.
