The Workplace Relations Commission ordered Avia Capital Leasing Limited to pay former Technical Manager Anton Gremin €11,970.80 in unpaid wages in a decision dated 18 August 2023. It found that Gremin was not unfairly dismissed after the company ceased business.
Gremin said the company told him in April 2022 that sanctions and banking restrictions had left it unable to operate or pay staff, and that it closed on 26 April. He said his wages for March and April were unpaid. A former senior financial manager supported his account. The company did not attend the hearing, but the WRC was satisfied it had notice.
The WRC found the termination fell within the definition of redundancy because the company had ceased business. It separately found the wage deductions were not authorised by law, his contract or his prior written consent, and ordered payment of €11,970.80. Gremin had started contract work elsewhere in July 2022, and the position later became permanent.
