WRC declines jurisdiction over disability discrimination complaint against O’Tooles Supervalu

The Workplace Relations Commission found it had no jurisdiction to investigate David Devoy’s complaint against O.T Investments Unlimited Company T/A O'Tooles Supervalu. The WRC decision was dated 5 January 2023. The complaint concerned an alleged refusal to serve him at the Tuam store when he would not wear a face mask. The WRC did not hear the substance of the complaint. The adjudicator accepted that a registered letter was sent on 23 February and delivered on 24 February 2022. But Devoy did not provide evidence that it contained the written notice required under section 21(2) of the Equal Status Act, so the WRC could not investigate the complaint. The merits were not decided.
