The Workplace Relations Commission found that Petrogas Group Limited did not discriminate against employee Agnieszka Posladek over its face-covering policy during the pandemic. The decision was dated 5 January 2023.
Posladek, a Bakewell Manager at an Applegreen site in Co Meath, said she could not wear a mask because of a disability. Petrogas said food-service staff had to wear full face coverings and offered her shop supervisory work where she could wear a visor, with training and the same pay. She declined the redeployment. The adjudication officer found the mask policy reasonable and the alternative work an appropriate measure to accommodate her difficulties, and concluded that she was not discriminated against. The officer noted that an internal appeal was not offered before her employment ended, but said that procedural flaw did not establish discrimination. The complaint concerned discrimination; contract and other procedural issues were outside its central scope.
