The Workplace Relations Commission awarded Krzysztof Cender €16,692 after finding that he had worked Sundays without additional pay for about 13.5 years. The decision, dated 5 January 2023, also ordered Onsite Facilities Management Ltd. to provide him with an updated contract referring specifically to Sunday premium within six weeks.
Cender said he worked every Sunday but received no premium until he raised the issue in April 2022. The company accepted that an oversight meant it had not paid him extra for Sunday work from the start of his employment, and said it began paying him double time on Sundays after he raised the issue.
The WRC found the complaint well founded under the Organisation of Working Time Act. The law requires reasonable compensation for Sunday work when it is not otherwise included in pay. The adjudication officer noted that Cender’s original contract did not include a Sunday premium provision and that the company had not supplied an updated contract with one. The award was described as equivalent to six months’ wages and just and equitable given that the pay issue had been corrected but had persisted for years.
