Yvonne Devlin lost her unfair dismissal, unpaid wages and redundancy complaints against Woodies DIY Limited, but the Workplace Relations Commission awarded her €456 because the company did not confirm a change to her role in writing. The WRC decision was dated 16 August 2022.
Devlin had worked as an online-store administrator in Tallaght. When the operation moved to Drogheda, she returned to a sales assistant role with evening and weekend shifts. She said she had worked weekday day shifts for years and considered the change and her dismissal unfair. Woodies said she repeatedly refused rostered shifts and that dismissal followed a disciplinary process.
The WRC found the dismissal was not unfair, noting that Devlin had declined an alternative administrative role and the phased introduction of the sales roster. It also found that wages were not properly payable during her unpaid suspension, and that her job was not redundant. Her successful complaint concerned the failure to give written notice of the role change. The €456 award was equivalent to one week’s pay.
