The Workplace Relations Commission upheld Ece Toprak’s complaints against La Selva Limited t/a Gringos Mexican Restaurant And Bar, awarding €2,500 for disability discrimination and constructive discriminatory dismissal and €2,500 for victimisation. Adjudication Officer Penelope McGrath’s decision was dated 12 March 2026.
The adjudicator found Toprak had referred to a depressive episode during a performance meeting on 30 April 2025 and that the employer was unmoved by the disclosure. She found the employer managed Toprak out within days and accepted that it humiliated her over a customer meal before she left on 9 May.
The employer denied discrimination, said it was unaware of a disability and attributed the breakdown in the relationship to Toprak’s attitude.
