Anne Smith awarded €12,123.04 in contractual notice claim

The Workplace Relations Commission found Anne Smith’s complaint against Parkfly Limited well founded and ordered the company to pay her €12,123.04. The decision was dated 16 August 2022. Smith said she had not received her full contractual notice entitlement of €16,923.04, equivalent to eight weeks’ pay, after her position was terminated on redundancy grounds. The WRC noted that the Department of Social Protection had already paid her €4,800 in statutory minimum notice. The WRC found a shortfall in the notice due under her contract. Contractual notice is the notice required by an employment agreement; the award was the amount due after accounting for the statutory notice already paid.
