The Workplace Relations Commission has ordered Tesco Ireland to pay Niall Finnegan seven weeks’ sick pay and €1,632.52 compensation after upholding his complaints over unpaid sick pay and a failure to confirm a store move in writing. The decision was dated 27 January 2026.
Finnegan alleged that Tesco withheld sick pay after he complained of workplace bullying and safety issues. Tesco said the sick pay decision was made under the discretionary terms of its policy during an active misconduct investigation and denied an unlawful wage deduction.
The WRC found the decision to refuse sick pay preceded Finnegan’s bullying complaint, so it rejected his safety-law penalisation complaint. It upheld the wage complaint and ordered payment of the remaining seven weeks under Tesco’s policy. The seven weeks’ pay order has no stated euro amount. The WRC also upheld his complaint that the store move was not confirmed in writing. The Sick Leave Act complaint was closed following the wage complaint outcome.
