WRC finds TUPE complaints by former Affidea worker out of time

The Workplace Relations Commission found Karen McEvoy’s complaints against Affidea Clinic Ltd were brought outside the time limit and were not well founded; the merits were not decided. McEvoy said her employment transferred to Relatecare in August 2020 and that Affidea later rehired staff to do her work at lower wages. Affidea said the transfer preserved her terms and conditions, and that later Waterford hires were for fixed-term roles on an HSE project. The WRC decision was dated 21 October 2022. The complaints concerned the Transfer of Undertakings Regulations.
