The Workplace Relations Commission found that Gareth Jones was not unfairly dismissed by CPL Solutions Limited T/a Flexsource, that his temporary agency work complaint was not well founded, and that the Minimum Notice Act was not contravened. The decision was dated 21 October 2022. Jones said the pharmaceutical company where he worked was his employer and that the dismissal process was unfair. The agency said Jones was its employee and that it dismissed him after he retrospectively completed a cleaning record at the facility. For unfair dismissal purposes, the WRC treated Jones as an employee of the pharmaceutical client, so it found he was not unfairly dismissed by the agency. His agency worker complaint failed because he gave no evidence of different treatment in the conditions covered by the Act. The agency had paid one week’s notice, and the WRC found no breach of the Minimum Notice Act.
