The Workplace Relations Commission upheld six complaints by David Byrne against Derfal Ltd National Lubes, including unfair dismissal, and awarded him €3,750 for an unauthorised wage deduction. The decision was dated 6 March 2023. Byrne, a former area manager, said he was dismissed without notice in August 2020 and was owed commission, holiday pay and wages. The WRC relied on his uncontested evidence after the respondent did not attend the hearing. The WRC found he had been summarily dismissed without an investigation, awarded €3,314.60 for unfair dismissal and €1,567.30 for lack of notice. It also awarded €3,314.60 for a breach of the Terms of Employment (Information) Act, €1,223.59 for unpaid commission and €2,093.75 for holiday pay.
