The Labour Court allowed the Services Industrial Professional Technical Union’s appeal and recommended £2,000 compensation for a Penn Racquet Sports craft worker transferred from rotating shifts to day work. The decision was signed on 29 November 1995. The union argued that the worker’s seniority had not been considered and that an offer based on 13 weeks of lost earnings was insufficient. Penn Racquet Sports said the fitters could not agree who should move, so management selected the fitter with the least service on shift. The Court found the compensation formula inappropriate given the change in work pattern.
