The Labour Court found that a worker was sexually harassed by a head chef and constructively dismissed after her hours were reduced. It ordered the company to pay her £5,000. The order was signed on 30 November 1995.
The worker said the head chef made repeated lewd and sexually explicit advances. The Court found that the conduct continued despite her making clear it was unwelcome, and that it was directed at her because she was a woman. It also found that the head chef reduced her hours, leaving her no alternative but to leave.
The Court held the company responsible for the head chef’s conduct because he harassed the worker while carrying out his staff supervision duties. It found a breach of section 3(4) of the Employment Equality Act, 1977, in relation to her constructive dismissal.
