The Labour Court rejected Imperial Tobacco’s appeal and upheld a recommendation that a worker receive four weeks’ sick pay. The decision was dated 23 July 2009. Imperial Tobacco said the worker had used up his sick pay and company-appointed doctors had found him fit to return. The Services Industrial Professional Technical Union said his GP had certified him unfit. The Court found the sick pay scheme did not address conflicting medical opinions and that the worker had complied with the company’s request for a medical certificate. It also upheld a recommendation that both sides review the scheme.
