The Labour Court upheld a €14,000 award to Aoife Foley after her former employer, Waterford Health Park Pharmacy Ltd T/A Stratus Healthcare, appealed the compensation amount. The Court’s decision was dated 29 April 2024.

The employer accepted that Foley had been unfairly dismissed but argued her financial loss was €5,742 and that she had no future loss after finding better-paid work. Foley said she was out of work for about 11 weeks before taking fixed-term work and later another job.

The Court said the statutory measure of financial loss was not limited to actual and estimated future losses. It also considered that the employer had conceded there was no procedural fairness in the dismissal. It found €14,000 was appropriate, upheld the original award and dismissed the appeal.
