The Labour Court reinstated Lucy Walsh after finding that Forum Connemara Co unfairly dismissed her by failing to renew her fixed-term contract. The determination was dated 9 December 2021.
Walsh appealed the Adjudication Officer’s €1,500 compensation award, seeking reinstatement. The Court found her written contract did not exclude unfair dismissal protections and that no justification for ending her employment had been offered at the time. It determined that reinstatement was the appropriate remedy, restoring her to the position she held when her contract was not renewed, when she was entitled to a further one-year contract under the Community Employment Scheme.
