The Workplace Relations Commission found three complaints by postal operative Michael Gerard Gilmartin against An Post not well-founded. The decision was dated 5 September 2024. Two complaints alleged less favourable treatment on the civil-status ground under equality law. The adjudication officer found the issues raised did not establish a case of discrimination on that ground, which the law defines by a person’s status as single, married, separated or divorced, widowed, or in a civil partnership or former civil partnership. A separate concern about being refused an extension to work beyond retirement age was outside the complaints and was not considered. Gilmartin also claimed unpaid overtime, mainly for Christmas periods since 2018. Most of the alleged payments fell outside the six-month period the WRC could consider, but the officer examined 3.5 hours from December 2023. Under the system described, the local manager decided how much overtime was payable; the officer found no additional amount was due. The overtime complaint was also found not well-founded.
