The Labour Court has overturned an age discrimination finding against Iarnród Éireann, ruling that Brendan Connor was not entitled to work as a gatekeeper until 70 after he had moved to other duties. The determination was signed on 11 September 2026.
Connor said he remained a gatekeeper after the Claremorris crossing was automated and believed he could work until 70. Iarnród Éireann argued the exemption applied only while a medically fit employee remained in a gatekeeper role. The Court found the exemption was tied to performing that role and did not follow him after redeployment. It set aside the earlier decision, which had found discrimination and awarded compensation.
