The Labour Court left Stefan Jennings’s €2,508 compensation award in place after refusing his employer’s appeal because it was filed one day late. The Court’s determination was dated 5 December 2022. Jennings had complained that Cidos Trading Ltd T/A Banba Toymaster failed to give him a written statement of his employment terms. The Adjudication Officer found the complaint well founded and awarded compensation equal to four weeks’ pay. The employer argued its appeal was in time or that exceptional circumstances justified the delay. The Court found the appeal was outside the statutory time limit and that the employer’s misunderstanding of the law and the one-day delay did not amount to exceptional circumstances. The appeal was refused on time-limit grounds, so the merits of the appeal were not decided.
