Labour Court upholds Woodies dismissal ruling on jurisdiction

The Labour Court upheld a ruling that it had no jurisdiction over Krzysztof Andraszak’s unfair dismissal complaint because the dismissal had been overturned before he lodged it. The merits were not decided. Andraszak said Woodies D.I.Y. Limited dismissed him on 10 December 2019 and stopped paying his salary. The company said an internal appeal overturned the dismissal on 4 March 2020, replacing it with a lesser penalty, and that he chose not to return to work. The Court found Andraszak had not been dismissed when he made his WRC complaint on 18 May 2020, so the Unfair Dismissals Act did not apply. It also noted that he had not been paid for the period between the initial dismissal and the internal appeal, and that Woodies indicated it was willing to pay him for that period at the appropriate team leader rate. The determination was dated 5 December 2022.
