The Labour Court found Agnieszka Szumera entitled to a statutory redundancy lump sum after Drumcondra Childcare Limited kept her on temporary lay-off for more than four weeks. The determination was dated 5 November 2018. Szumera, a part-time cleaner, appealed an Adjudication Officer decision. She ended her employment by letter after being laid off from 25 August 2017. The Court found that her letter counted as notice of an intention to claim. The employer said it had sent a counter-notice offering continued employment, but its representative did not produce the letter. The Court found the claim well-founded. The lump sum calculation was based on weekly pay of €190 and employment from 1 March 2012 to 1 January 2018.
