The Labour Court rejected Darius Mucha’s appeal against G4S Cash Solutions Ireland Limited over his claims of disability discrimination and failure to make reasonable accommodation. The Court affirmed the Adjudication Officer’s decision in a determination dated 6 November 2018.
Mr Mucha worked as a cash service operative for G4S. After an occupational health assessment said he should be fit to return in January 2016, the company arranged a meeting to discuss his return. He said he needed to consult his GP before deciding, and the Court found G4S facilitated that request.
He resigned on 18 January 2016 after speaking with his GP. The Court found his decision reflected his view that his health made him unsuitable for the job, rather than a belief that G4S had failed to accommodate his disability. It also found that his GP’s letter did not suggest he wanted to explore accommodation and that his resignation email did not allege such a failure. The appeal failed and the earlier decision was affirmed.
