The Labour Court rejected Emer Moran’s appeal against the finding that her complaint under the Parental Leave Act was not well founded. Its decision was dated 12 February 2020, and the Adjudication Officer’s decision was upheld. Moran said she was dismissed in retaliation for taking force majeure leave. Penn Plax Incorporated said she had been placed for a two-month period and denied penalising her. The Court found Moran had not applied for the leave or notified the employer in the manner required by the Act, and concluded Penn Plax had not penalised her.
