The Labour Court overturned the adjudication officer’s decision and awarded Margaret Coleman €1,033.92 in notice pay. The determination was signed on 25 January 2022.

Coleman worked for Boots Retail Ireland Ltd, Boots Retail Ireland as a customer assistant from September 2014 and became a beauty advisor in 2016. She was dismissed on 17 October 2018 and received no payment in lieu of notice.

The Court linked the notice claim to its decision in a separate unfair-dismissal appeal, in which it had found that the decision to dismiss Coleman for gross misconduct was unfair. It found she was entitled under the Act to two weeks’ paid notice.

The Court noted her annual salary was €26,882 and determined that two weeks’ notice pay amounted to €1,033.92. It said the appeal succeeded and overturned the adjudication officer’s decision. This award concerns the notice-pay claim; it is separate from the compensation awarded in Coleman’s unfair-dismissal appeal.
