The Labour Court upheld an adjudication officer’s recommendation on two complaints by Beaumont Hospital chef Kenneth McKnight, with an amendment that he return to his post immediately. The Court’s decision was dated 25 January 2022. McKnight had complained about how Beaumont Hospital handled two matters: a colleague’s complaint that he had treated her inappropriately and aggressively, and complaints by four people that he had treated them inappropriately and in an intimidating manner. The Court found both of McKnight’s complaints not well founded. On the first complaint, the Court said Beaumont had provided reasonable and fair opportunities for McKnight to raise his concerns, including mediation and the grievance process. On the second, it found that an external investigation had addressed the concerns about management’s earlier involvement. The amended recommendation said McKnight should return from paid administrative leave immediately, without affecting the pending disciplinary process, which should conclude as soon as practicable.
