Labour Court recommends HSE worker accept Ballinasloe as work base, with flexibility

The Labour Court recommended that a senior occupational therapist accept Ballinasloe as her work base with the Health Service Executive HSE West, while encouraging flexibility where possible. The recommendation was dated 29 April 2024.

The worker said she had worked from Roscommon Town since joining the HSE in 2013 and relied on her contract, established practice and client base there. The HSE said she had applied for and accepted a role in a team based in Ballinasloe, where operational requirements placed the post.

The Court said the worker knew the role was based in Ballinasloe when she accepted it and that it was not for the Court to interfere with the employer’s operational requirements, while recognising that her personal circumstances had changed. It recommended that she coordinate attendance with colleagues and that the employer facilitate flexible working where possible.
