The Labour Court upheld the finding that Ilona Chorzepa’s public holiday pay complaint against Bausch Health Ireland Limited T/A Bausch and Lomb was not well-founded. The determination is dated 29 April 2024. Chorzepa challenged calculations for shifts that partly fell outside public holidays and argued that regular overtime should count when calculating pay for holidays she did not work. The company said its payments met the regulatory requirements and that overtime was excluded from those calculations. The Court found that she had received at least the compensation required for holidays she worked and those she did not, and had suffered no detriment. It said the law did not provide for the additional payments she sought.
